How the deadlines are set
Two federal rules now set a technical standard and a date for web accessibility. The DOJ Title II rule (28 CFR Part 35) covers state and local governments and requires WCAG 2.1 AA by April 26, 2027 for entities serving 50,000 or more people, and by April 26, 2028 for smaller entities and special purpose districts.
The HHS Section 504 rule (45 CFR Part 84) covers recipients of HHS financial assistance and requires WCAG 2.1 AA by May 11, 2027 for recipients with 15 or more employees, and by May 10, 2028 for those with fewer than 15. Private businesses are covered by Title III of the ADA, which has no fixed web deadline but is enforced under current law.
